Your caption will depend on the point of your advert. You really need to conceptualise on copy before artwork, or at least at the same time.
This ad could however say:
1 - Self Imposed Death Sentence
2 - The death sentence is illegal in some countries. Why isn't smoking?
3 - Hanging or Lethal Inhalation: Your Choice.
4 - Death to Marlboro, smoke Camel. (RE: Waleed comment 1)
On Point 3 : How about an image of a guy lying in the "lethal injection" room, being forced to smoke himself to death?
I agree with rather hanging a cigarette there. It could be smouldering.
Or a hybrid man/cigarette. A guy burning from the feet up (not gross, just like a cigarette) All charcoal up to the knees, then some red hot embers and some smoke. "Smoking kills, eventually."
There are so many options... the question we actually need to ask is... do smokers care? It's just like a high alcohol, caffeine, fat, sugar etc. diet. It all kills in the end.

Well, the pack of cigarettes doesn't look realistic in the noose. If you choose to stay with this visual, you still need to work on it a bit. The dpi on the pack is not as high as it is with the noose, so as a result, it doesn't look right.
That being said...I agree with an earlier recommendation of using just a single cigarette instead of the whole pack. Then you won't have to worry about the copyright issue with the name of the cigarette manufacturer. Major lawsuit happening there.
You could go with something similar to an earlier comment about the ambulance wheeling in a gurney with a dead body on it—not alive—with the toe tag and somehow clearly demonstrate that this person died of lung cancer. Can do almost anything really...Good luck.
