How do you check the legality of a new logo?

When designing a new logo for a client, how do you check or handle potential problems that someone already has the same/ similar logo already?

i.e. Quark and the Scottish Arts Council.

One way is to post on forums like the Critique section. We will certainly spot it if it's been done.

And go to uspto.gov and search for your company name, one to see if the name is trademarked already, and two, to see what logos those companies have.

I agree with Ivan that some gold old fashioned bulletin board posting helps too.
